Terms & Conditions

1. Agreement
These Terms & Conditions (“Terms”) are an agreement between you and Modar LLC (“Modar”, “we”, “us”), a limited liability company registered in New Mexico, USA. By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
2. The Services
These Terms apply to modar.cc, the Aelati (عائلتي) mobile app, and the Shjrti (شجرتي) platform at shjrti.com (the “Services”). We may add, change or remove features at any time. Some features are available only on a paid plan.
3. Eligibility
- You must be at least 13 years old to create an account.
- If you are under 18, or under the age of majority where you live, you may use the Services only with the permission of a parent or guardian, who agrees to these Terms on your behalf.
- A parent or guardian who adds a child under 13 to an Aelati family is responsible for that child’s information and use of the app.
- You may not use the Services if you are barred from doing so under applicable law.
4. Accounts and families
- You must provide accurate information and keep your sign-in credentials, devices and verification codes secure. You are responsible for activity that happens under your account.
- Tell us promptly at me@modar.cc if you believe your account has been compromised.
- In Aelati, a family’s administrators control who can join, and members can see content shared within the family. In Shjrti, a tree’s owner controls collaborators, share links and privacy settings. Choose carefully who you invite.
5. Subscriptions and payments
- Prices are shown before you buy.
- Aelati subscriptions are purchased and billed through the Apple App Store or Google Play and are subject to their terms. They renew automatically at the end of each billing period unless you cancel at least 24 hours before the renewal date in your App Store or Google Play subscription settings. Cancellation takes effect at the end of the current period.
- Shjrti — card payments through Stripe are one-time payments for the plan period you choose and do not renew automatically. To continue after the period ends, you renew manually.
- Shjrti — PayPal subscriptions renew automatically each year until cancelled. You can cancel at any time in your PayPal account under automatic payments, or by emailing support@shjrti.com. Cancellation takes effect at the end of the current period.
- Free trials. If a plan includes a free trial, you will be charged when the trial ends unless you cancel before then.
- Refunds. Except where required by law, payments are non-refundable. Refunds for App Store and Google Play purchases are handled by Apple or Google under their policies.
- Price changes. We may change prices. We will tell you in advance, and a new price applies from your next billing period.
- Family plans. Where a plan covers a whole family, the benefits may end for all members if the subscriber cancels.
6. Your content
- You own it. You keep ownership of the text, photos, videos, voice messages, documents, family-tree data and other content you add (“Your Content”).
- Licence to us. You give Modar a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, display and transmit Your Content only as needed to operate, secure and improve the Services and to show it to the people you choose. This licence ends when Your Content is deleted, except for copies kept as described in our Privacy Policy or already shared with others.
- Your responsibility. You confirm that you have the rights needed to add Your Content, including consent where required from the people it depicts or describes — such as relatives in a family tree, people in photos, and emergency contacts.
- Backups. Keep your own copies of anything important. To the extent permitted by law, we are not responsible for loss of Your Content.
7. Acceptable use
You agree not to:
- break the law or violate anyone’s rights, including privacy and intellectual property rights;
- upload content that is unlawful, abusive, harassing, hateful, sexually explicit, or that exploits or endangers children;
- track, monitor or share another person’s location or information without their knowledge and consent;
- impersonate anyone or add false information about real people;
- send spam or unsolicited invitations;
- access accounts, families or trees that are not yours, or try to bypass security or usage limits;
- scrape, reverse engineer, or interfere with the Services, except as allowed by law; or
- resell or commercially exploit the Services without our written permission.
We may remove content or restrict accounts that we reasonably believe violate these Terms. You can report abuse to me@modar.cc.
8. Not professional or emergency services
- SOS and location are not an emergency service. They depend on your device, connection, permissions and third-party networks and may be delayed or fail. In an emergency, contact your local emergency number directly.
- Medications and vaccinations are reminders and records only. They are not medical advice; always follow the guidance of a qualified healthcare professional.
- Zakat calculations, budgets and debts are estimates to help you organize. They are not financial, tax or religious rulings; consult a qualified scholar or advisor.
- Wills recorded in the app may not meet the legal requirements for a valid will where you live. Family members may be able to request access to a will you record. Consult a qualified lawyer to prepare a valid will.
- Prayer times and weather come from third-party sources and may be inaccurate.
- Family-tree information is added by users and may be incomplete or inaccurate. We do not verify lineage or relationships.
9. Our intellectual property
The Services, including their software, design, logos and the names Modar, Aelati, عائلتي, Shjrti and شجرتي, belong to Modar or its licensors and are protected by law. We give you a personal, limited, non-transferable, revocable licence to use the Services under these Terms. If you send us feedback, we may use it without any obligation to you.
10. Third-party services
The Services rely on or link to third-party services, such as app stores, payment processors, sign-in providers and map providers. Their own terms and policies apply, and we are not responsible for them.
11. Suspension and termination
You can stop using the Services and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect users or the Services. Where reasonable, we will give notice. Sections that by their nature should survive termination — including 6, 8, and 12 to 17 — will survive.
12. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, MODAR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT NOTIFICATIONS, REMINDERS OR ALERTS WILL BE DELIVERED.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MODAR AND ITS OWNERS, EMPLOYEES AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 100. Some jurisdictions do not allow these limitations, so they may not fully apply to you. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
14. Indemnity
To the extent permitted by law, you agree to indemnify and hold Modar harmless from claims, losses and expenses (including reasonable legal fees) arising from Your Content, your misuse of the Services, or your breach of these Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days. Any dispute that is not resolved will be heard in the state or federal courts located in Bernalillo County, New Mexico, unless the consumer laws of your country of residence give you the right to bring proceedings in your local courts.
16. Changes to these terms
We may update these Terms. We will change the effective date above and, for material changes, notify you through the Services or by email before they take effect. If you keep using the Services after the changes take effect, you accept the updated Terms.
17. General
These Terms, together with the Privacy Policy, are the entire agreement between you and Modar regarding the Services. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a business transfer. If the English and Arabic versions differ, the English version prevails.
